In December of 1864 he transferred into company K of the New York 61st infantry. He was listed as a prisoner of war in October 1863 at Auburn VA (confined at Macon Georgia and Columbia South Carolina). He was promoted to a second lieutenant in 1862. He was even a sort of activist you could say, because he signed a petition complaining of Camp Sorghums conditions!
